Nairobi County Assembly Speaker Beatrice Elachi (pictured) has gone to court seeking to suspend a court injunction stopping her from presiding over House sittings.
Joy Furaha Mranja, a Nairobi resident, had last week moved to court and obtained orders barring the Speaker from accessing the assembly precincts and presiding over sittings until an impeachment Motion against her was debated.
Under a certificate of urgency filed through lawyer Harrison Kinyanjui, Ms Elachi argued that her rights to discharge her constitutional and statutory functions of the assembly had been compromised and totally curtailed by the order.
SEE ALSO :Appeal to have South B road renamed Joe Kadenge In court documents seen by The Standard, Elachi urged the court that pending hearing and determination of the application, the execution of any aspect of the “consent order” purportedly dated October 25, 2019, be suspended.
“The first respondent (Elachi) has never been served with any process herein by the petitioner. Indeed, no affidavit of service was ever filled in these proceedings by a licensed process server indicating how, when and to whom process was served or indeed at which office of the Speaker (first respondent) was ever served,” read the petition.
Elachi further urged the court to nullify her purported representation by lawyer Steve Mogaka and that the said notice of appointment be struck out and expunged from court records.

This comes against the backdrop of a fresh bid to impeach Elachi by a section of Jubilee MCAs.
On Monday, they vowed to oust Elachi on the same grounds that saw her hounded last September.
