Case Challenging CJ Picking Process Is Dead –Lawyers

Lawyers representing activist Memba Ocharo who went to court  seeking orders  to stop search for Chief Justice now say the case is dead.

According to Ocharo’s  lawyer Shadrack Juma the decision by Court of  Appeal to give the process a green light was the end of the road and that the matter has now been overtaken by events.

‘‘Ocharo was in court yes but court of appeal ruled that the process should continue even as we pursue it, this means that everything has been overtaken by events and the case can only be used for academic purposes,’’ he said.

He however blamed the court of appeal for not considering Ocharo’s rights and that the move to have the exercise proceed was hurriedly conducted.

‘‘We must register our disappointment with the  decision, Chapter Six was ignored and Court of Appeal also infringed into High Court power but it is a fight we will not relent on as our president Nelson Havi puts it,’’ he added.

CJ nominee Martha  Koome  who now awaits parliament approval before assuming office. She defended the process saying she is equal to the task.

“I appreciate this was after a thorough, rigorous and a very competitive process that saw some of the best legal minds come forward as capable candidates demonstrating their willingness to serve Kenyans,” Koome stated in her acceptance statement.
