Butcher to serve 15 years for defiling school girl

A butcher who defiled and impregnated a school girl at Kiandai village, Kirinyaga East subcounty has been jailed for 15 years by a Gichugu court.

Bedan Kaburucho, 56, pleaded for leniency and told the court he was remorseful, besides being the sole breadwinner for his family.

He was charged with committing the offence on diverse dates between May 1 and 31, 2017.

He denied the charged and asked the court to halt the proceedings until the girl gave birth to enable a DNA test.

Resident Magistrate Gwere Odhiambo allowed the request but after the tests were carried out by a government analyst Dr Nellie Mariam on July 25, last year, the results proved the accused fathered the girl child.

A letter produced in court by the analyst indicated that the DNA results were 99.99 positive that Kaburucho alias Silio was the father of the child after the defilement ordeal.

During the hearing, Kaburucho who was represented by Maina Kagio appeared tense, after the girl attended the proceedings while strapping the infant on her back.

It also emerged the defilement took place within the girl’s family coffee shamba after Kaburucho bought an acre of the land from her parents.

The minor in her testimony told the court how the butcher would frequent to their home during the land buying deal and how he used to waylay her while on the way from school.

“Kaburucho used to drag me into the coffee bushes and defile me while threatening me not to report him to my parents and within the period, he impregnated me,” she said.

While sentencing the accused, the magistrate said the prosecution had proved its case beyond any reasonable doubts.

However, he was given the right of appeal within the next 14 days.
