Parliament Monday suffered a blow after the High Court declined to set aside orders barring the vetting of 51 Principal Secretary nominees.
High Court judge Nduma Nderi said he will next Tuesday deliver a ruling on the issue of jurisdiction that was raised by the National Assembly.
The National Assembly litigation counsel had challenged the order arguing that, according to the law, if the 51 nominees are not vetted within 28 days then they will automatically be sworn into office.
The Employment and Labour relations court last Tuesday issued an order stopping the vetting process pending the determination of a petition filed by the Law Society of Kenya (LSK).
The lawyers’ association claimed the appointments did not meet the constitutional threshold.
