Family of the late former rally driver Asad Khan has strongly opposed the closure of the investigation file before the DPP makes a decision whether to charge Maxine Wahome.
The aggrieved family through their lawyer Danstan Omari told Senior Principal Magistrate Benard Ochoi that the file application cannot be closed when the DPP has not disclosed the outcome of the investigation.
He said the attempt by the investigating officer asking the court to close the file goes ahead and undermines the pending decision of the DPP.
He said that the aggrieved family is more concerned to know who killed the former rally driver.
Maxine Wahome was arrested on 12 December 2022 and produced in court in the same month where police sort time to investigate the course and people behind the death of the late Rally driver.
However, she was given bond and ordered to be reporting to the DCI Kilimani every Thursday of the week.
The court said it will make it decision on 15th February on whether to allow application by the Prosecution or take stand by the family of the late rally driver.
