Garissa university terror suspects have a case to answer

Four terror suspects charged over Garissa university attack in 2015 have a case to answer.

Chief Magistrate Francis Andayi put to defense Sahal Diriy Hussein, Hassan Edin Hassan, Mohamed Abdi Abikar and Tanzanian Rashid Mberesero after the prosecution presented sufficient evidence linking them to the attack that left 148 people dead.

One of the suspects, Osman Abdi Dagane, was however acquitted.

Dagane who was a guard at Garissa university during the attack four years ago was set free for lack of evidence.

The prosecution which had presented 22 witnesses had claimed that Dagane was found taking photos at the scene of the attack but the court found no evidence to support the claim saying there was no link between him and the attackers.

Elsewhere, the court will on February 4th rule on whether to allow the application by prosecution requesting 30 days to continue holding six suspects accused of financially facilitating the Dusit D2 attack.

Lawyers representing the accused want their clients released pending investigations. Appearing before senior principal magistrate Martha Mutuku, the lawyers claimed that the prosecution ought to have completed investigations within the 8 days the suspects have been in custody.
