NYERI, Kenya, Jul 27 – A Kenya Defence Forces (KDF) major who murdered his family in Nanyuki will spend more time in prison custody after the Director of Public Prosecutions (DPP) filed a preliminary objection to his release on bond pending the hearing of his case.
Peter Murage will have no choice but to cool his heels at Nyeri King’ong’o prison until September when the high court judge Martin Muya will rule on whether he has jurisdiction to release him on bond.
When the case came for bond ruling, State Counsel Pithion Mwangi for director of prosecution told the court that they are raising preliminary objection on the grounds that the court has addressed the issue of bond before.
“Your honour we have raised objection on this matter this court has addressed the issue of accused bond for a record four times to us you have no jurisdiction and as such the accused should move to court of appeal,” he said.
Mwangi further told the court that circumstances that denied mugure bond have not changed and a such his application for bail is frivolous and incurable.
However his lawyer George Gori accused prosecution of frustrating efforts by mugure to benefit from his constitution right since major witness have testified.
“Your honour this is just but a wider effort to scuttle my clients right to bond most of witness especially junior officers have testified I do not see anything that can make my client fright risk,” Gori said.
He said that denying his client bond basing it on other judges ruling is frivolous since they had their own reason and under different circumstances.
Mugure who has been in custody since 2019 is accused that on November 2019 he murdered his wife Joyce Syombua and two of their children Shanice Maua and Prince Michael.
Muya will give his ruling on September 16 this year.
