Korogocho MCA Abisalom Odhiambo alias Matach Matakwei Mobimba has been arraigned in court today a day after he was arrested over alleged incitefull comments at a public rally.
His lawyers Danstan Omari and Shadrack Wambui opposed the request to have him detained for seven more days as requested by the DCI.
“The head of state can record the statement ..you have been told he is a national security threat .. this is just a mere MCA how can that be true ..and to contextualize this matter tax payers pay the officers to do their job the police is intact and will arrest if they want.This my honour is politics being brought before you.” Omari told Court.
“If you turn to authority I have shared with the court and noted a two tier approach to be looked at and must be persuaded and it’s being made in good faith..when the arresting officer says the respondent is habitual offender then it’s not done in good faith therefore does not stand.
When the court is approached by this kind of the application then court must relook article 24 ..further it will be travesty to justice to detain others who is alleged to be working who have not been arrested Court should disregard and dismiss the application to detain him.” Wambui the respondent lawyer told court.
The court will give ruling on the matter tomorrow morning.
