Linturi says Kitany using suit to defraud his properties

Meru Senator Mithika Linturi on Tuesday urged a Nairobi court to dismiss an application by Marianne Kitany, who claims to be his wife, saying she was trying to fraudulently strip him of his property.

Mr Linturi, through his lawyer Muthomi Thiankolu, said Ms Kitany concealed some facts from the court, when she obtained temporary orders allowing her exclusive use of their Runda home.

He maintained that he has never married, cohabited or had any relationship with Ms Kitany and refuted claims that Ms Kitany was a “jobless housewife with no stable income”.

He said she has several multi-million shilling properties, businesses and assets.

Mr Thiankolu told the court that Ms Kitany lacked evidence to prove that Mr Linturi had been violent towards her. He said, instead, it was Ms Kitany who has been “cruel, mean and hostile towards my children who are still at a tender age”. Ms Kitany, through lawyer Danstan Omari, insisted that there was a personal relationship between them and she was not a visitor as alleged by Mr Linturi.

He said the amount of time they spent together, cannot be wished away and that she even campaigned for him during the 2017 General Election.

Mr Omari argued the court has a duty to protect the dignity of people in personal relationships and any forceful eviction, without due regard to the law must be resisted. “She is a jobless former public servant while the respondent is a powerful senator,” he said.

Senior resident magistrate Isaac Orenge will rule on the matter on February 1.

The court extended orders granting Ms Kitany exclusive use of the Runda house.

Other properties listed in court papers include six prime plots in Kajiado, money in five bank accounts at Standard Chartered #ticker:SCBK, Equity #ticker:EQTY, Family, Co-operative #ticker:COOP and Credit banks.

Others are a Range Rover and Toyota Lexus and firms known as Litany Investments Limited, Arc Business Solutions Ltd, Arkchoice Insurance Brokers Limited, Arkchoice Pharmaceuticals, Arkgroup Limited, and Fancy Solutions Limited.
