Man found guilty of assaulting, injuring Wajir politician

A Somali national has been found guilty of assaulting a politician from Wajir County leaving him with permanent disability.

Delivering the ruling, Makadara Law Courts Resident Magistrate Eunice Kimaiyo ruled that Jamal Mohammed indeed assaulted politician Hussein Mohammed who unsuccessfully contested for the Wajir South Parliamentary seat in 2017.

“I find the accused guilty of assault and causing grievous harm to complainant Hussein Mohammed and I convict him,” ruled Kimaiyo.

In convicting the accused, the magistrate ruled that the prosecution had proved all the ingredients of the offense as per the section 234 of the penal code.

“It was manifested clearly that the accused person was positively identified as the person who occasioned the injuries to the complainant,” ruled Magistrate Kimaiyo.

“The evidence filed by the prosecution is solid and I have no doubt the Hussein was assaulted.”

The accused through his lawyer, Cohen Amanya, pleaded with the court to grant him a lenient sentence saying that he has a wife in Kenya and a young child.

Jamal, who is an American citizen, is alleged to have assaulted Hussein outside a Mosque on September 17, 2017 at Eastleigh 7th street in Kamukunji leaving him with serious injuries on the left leg.

He was also charged of being in Kenya illegally.

Jamal denied all the charges and is out on a Kenyan surety bond of Ksh.300, 000.
