It has further been established that on June 5 2019, Ida Odinga the wife of Raila wrote to Lwam Bekele and sought for her view in regard to the succession of the estate of late Fidel.
This is because after Fidel’s death, Lwam had moved out of her matrimonial home, and had also cut links with the Raila family.
However she did not accede to the request, but she merely informed Ida to contact her lawyer.
Her lawyer was contacted too but remained unresponsive for a while, only for Ida to discover that Lwam had filed a succession cause in September 2018, and a limited grant issued in 2019, without informing the family.
When Ida obtained the documents from court, she was surprised to note that Lwam had placed her brother as a co-administrator to the estate of Fidel, and her mother as the surety, all parties who are foreigners.
This prevailing position forced Ida to file for an objection to the petition, given that certain intended beneficiaries had been locked out, and they stood to be disadvantaged.
The Raila family wants to be included to protect the estate for the benefit of all the beneficiaries of the estate.
According Ida’s lawyers, it is the vulnerable children that the Railas claim were sired by Fidel that are being fought for and not property. The grand mother is the most neutral person to fight for them, because she regards all the grand children as equal, and desires that they are all treated fairly including those of the petitioner, hence the need for her to be the objector, as opposed to the mother of the twins, who has also no interest in the estate – properties. Ida and Fidel’s sister, Winnie, have moved to court to have two of other children they say are Fidel’s sons included as beneficiaries of his estate.
They want a grant of probate of the estate of Fidel. The deceased died intestate domiciled in Nairobi and present their petition in their capacity as the mother and sister of the deceased respectively.
They further say that the deceased was legally married to one Lwam Bekele, and with her they had one son, Allay Raila Odinga, and that while the deceased was married to Bekele, he had two twins from a different relationship whom he supported during his lifetime.
They are apprehensive that the widow to the deceased plans to move on with her life and may relocate to any other country and deny them a connection and a relationship with their grandson and nephew respectively.
They also feel that the petitioner herein has multiple citizenships namely Eritrean, American, Kenyan and holds passports of all such nationalities and may erratically relocate to anywhere
